Texas Can Ban Emergency Abortions Despite Federal Guidance, Court Rules

The U.S. Court of Appeals for the Fifth Circuit ruled that Texas emergency room doctors are not required to perform emergency abortions, upholding a previous decision supporting the State of Texas. Texas had sued the Biden administration, contending that the federal guidance issued in 2022 was an overreach that would impose abortions. Judges Leslie H. Southwick, Kurt Engelhardt, and Cory Wilson heard the appeal, with Judge Engelhardt clarifying that the federal guidance does not mandate any specific type of medical treatment, including abortion. The ruling comes amid ongoing legal battles over abortion rights in Texas following the Supreme Court’s decision to overturn Roe v. Wade in 2022. This decision adds to the uncertainty for doctors in Texas regarding which cases legally qualify for an abortion.
