Supreme Court to Hear Challenge to Idaho’s Strict Abortion Ban
The U.S. Supreme Court has agreed to hear a challenge to Idaho’s near-total ban on abortions, which the Biden administration says conflicts with federal law allowing for certain exceptions. The controversial law, enacted in 2020, was temporarily revived and is set to take effect in August 2022 after being partly blocked by federal trial judges. Its provisions allow exceptions for abortions necessary to prevent a woman’s death but not for those needed to address threats to her health. The law has caused conflict with the Emergency Medical Treatment and Labor Act, which mandates emergency rooms in hospitals receiving Medicare funding to provide treatment necessary to stabilize patients, including abortions.
