Justice Department to pursue death penalty against Buffalo supermarket shooter Payton Gendron

The Justice Department is seeking the death penalty for Payton Gendron, who killed 10 people in a racially motivated shooting at a supermarket in Buffalo, New York, in May 2022. Federal prosecutors have outlined the reasons for seeking a death sentence, including intentional killing, infliction of bodily injury, participation in an act resulting in death, and racism associated with the shooting. The lawyers for Gendron had previously indicated that he would plea guilty if the death penalty was removed from consideration. Gendron has been charged with multiple counts of hate crimes resulting in death and firearms offenses. He was also sentenced to life in prison without parole on state charges in February 2023.
