Family of San Diego woman fatally shot storming Capitol sues U.S. for $30M – NBC 7 San Diego
The family of Ashli Babbitt, a San Diego woman killed during the Jan. 6, 2021, U.S. Capitol breach, has filed a $30 million wrongful death lawsuit against the U.S. government. The lawsuit alleges Babbitt, an Air Force veteran, was “ambushed” by an U.S. Capitol police officer who shot her without issuing any warnings or commands. The Department of Justice declined to pursue criminal charges against the officer, Lt. Michael Byrd, who also did not face internal discipline from the U.S. Capitol police. The lawsuit claims Babbitt was unarmed, posed no threat, and that Byrd did not identify himself as a police officer before opening fire. During an August 2021 television interview, Byrd stated he shot Babbitt as a “last resort”.
