Buffalo shooter who killed 10 at Tops supermarket to face death penalty in federal case
The federal prosecutors will seek the death penalty against Payton Gendron, a white supremacist who killed ten Black people in a mass shooting at a Buffalo supermarket in 2022. Gendron, already serving a life sentence with no parole after pleading guilty to state charges of murder and hate-motivated domestic terrorism, had chosen the location to “maximize the number of Black victims,” according to U.S. attorney Trini Ross. Although New York doesn’t have capital punishment, the Justice Department can seek the death penalty in a separate federal hate crimes case. This marks the first time that Attorney General Merrick Garland has authorized a new pursuit of the death penalty, even as the Justice Department has limited federal death penalty cases under President Biden’s leadership, who opposes capital punishment.
