Appeals Court Allows California Ban on Guns in Most Public Places to Take Effect
A federal appeals court has allowed a ban on carrying firearms in most public areas in California to proceed in 2024, overturning a lower court judge’s decision that claimed the ban was unconstitutional. The state law, known as Senate Bill 2, includes several restrictions on gun ownership, and was approved by Governor Gavin Newsom last year. While supporters like Newsom and State Senator Anthony Portantino argue that the law will improve public safety, opponents, including the California Rifle & Pistol Association and the Second Amendment Foundation, claim it infringes on citizens’ right to bear arms. The law also sets the minimum age for obtaining a gun license to 21 and introduces more requirements for gun safety training, while banning firearms on private business premises unless clear signage indicates otherwise. The Ninth circuit court of appeals has paused enforcement of the law, allowing it to take effect while it further considers its constitutionality.
